By booking, scheduling, submitting a form, checking acknowledgment boxes, or providing an electronic signature through this website, the Client/Owner/Agent acknowledges that they have read, understood, and agreed to the following terms and conditions with The Red Mare Equine Recovery regarding all horses presented for services.

Service Description

The Red Mare Equine Recovery provides non-invasive, localized CO₂ cryotherapy services intended to support healthy circulation, maintenance, recovery, and overall comfort in horses. These services are not veterinary treatment and are not intended to diagnose, treat, cure, or prevent any medical condition, injury, or disease.

Cryotherapy services are intended as a supplemental wellness and maintenance service only and are not a replacement for veterinary care, farrier care, rehabilitation programs, or other licensed professional services.

Assumption of Risk & Release of Liability

The Client acknowledges that horses are inherently unpredictable animals and that working with horses involves inherent risks, including but not limited to kicking, biting, striking, pulling away, slipping, sudden movement, behavioral reactions, environmental hazards, and reactions to pressurized cryotherapy equipment and cooling exposure.

To the fullest extent permitted under Arizona Revised Statutes § 12-553 and applicable Arizona law, the Client voluntarily assumes all risks associated with participation in cryotherapy services and hereby releases, waives, and holds harmless The Red Mare Equine Recovery, and its representatives, contractors, affiliates, and operators from any and all claims, liabilities, damages, injuries, expenses, losses, or causes of action arising out of or related to:

  • Equine behavior

  • Handling of the horse

  • Reactions to cryotherapy services

  • Equipment operation

  • Participation in services

  • Presence on property or at service locations

  • Any outcome related to services provided

Care, Custody, and Control

The Client and/or the Client’s designated handler retains full responsibility for the horse at all times. The Red Mare Equine Recovery does not assume care, custody, or control of any horse at any time during transport, preparation, treatment, handling, or post-session recovery.


Condition-Specific Support Acknowledgment

The Client/Owner/Agent understands that any service names, package titles, focus areas, or descriptions referencing conditions, soreness patterns, recovery concerns, performance support, or anatomical regions — including but not limited to laminitis, founder, navicular disease, tendon injuries, suspensory injuries, kissing spine, arthritis, hock soreness, stifle soreness, or soft tissue discomfort — are provided for general supportive wellness and recovery context only and do not imply diagnosis, treatment, rehabilitation, medical claims, guaranteed outcomes, or veterinary recommendation.

The Client/Owner/Agent acknowledges that results may vary between horses and that no outcome, improvement, or recovery is guaranteed.

Safety Operations & Technician Standards

To maintain safe operating conditions for the horse, handler, and technician, the following standards are strictly enforced:

Environment & Handling

The Client agrees to provide a safe, level, and controlled environment suitable for cryotherapy services, including appropriate restraint methods such as cross-ties, wash racks, or other secure handling systems. A capable handler must be present if the horse cannot be safely secured or managed.

Horse Condition (Dry & Clean)

The Client agrees that the horse must be completely dry and reasonably clean before the appointment begins. Mud, moisture, debris, sweat, topical products, or wet hair coats may increase the risk of adverse skin reactions when exposed to pressurized low-temperature CO₂ spray.

If the horse is not adequately prepared upon technician arrival, services may be delayed, refused, rescheduled, or subject to a Non-Refundable Failed Preparation Fee.

Medical & Behavioral Disclosure

The Client agrees to disclose all known injuries, sensitivities, medications, behavioral concerns, prior reactions, veterinary restrictions, or handling triggers before services begin.

The “45-Minute Rule”

The Client agrees that strenuous exercise should not occur within 45 minutes before or after cryotherapy services in order to support an appropriate vascular response and recovery period.

Restricted Areas
Cryotherapy services will not be performed on the face, poll, ear area, eyes, mucous membranes, open wounds, or other restricted areas deemed unsafe due to the pressurized nature of the equipment and extreme cooling temperatures.

Right to Refuse or Terminate Services

The Red Mare Equine Recovery reserves the right to pause, refuse, modify, or terminate services immediately if the horse, handler, environment, weather conditions, equipment conditions, or overall situation is deemed unsafe at the sole discretion of the technician.

No Guarantee of Results

The Client understands and acknowledges that every horse responds differently to cryotherapy services. While some horses may experience improved comfort, circulation, maintenance support, or recovery response, no guarantees, warranties, or medical claims have been made regarding specific results, performance outcomes, injury resolution, soundness, or recovery timelines.

Cancellation & Appointment Policies

Appointments require a minimum of 24-hour notice to cancel or reschedule. Late cancellations, repeated rescheduling, failure to prepare the horse, or missed appointments may result in forfeited session fees, deposits, travel charges, or rescheduling fees.

Electronic Signature Agreement

By checking acknowledgment boxes, submitting forms, booking services, or typing their full legal name electronically through this website or booking platform, the Client acknowledges and agrees that:

  • They have carefully read and understood this Release and Waiver of Liability

  • They voluntarily agree to all terms stated above

  • They are authorized to act on behalf of the horse owner if signing as an agent, trainer, lessee, or representative

  • Their electronic acknowledgment and signature shall be considered legally binding and equivalent to a handwritten signature under applicable law
